La Suite Dior
General Terms of Sale
PREAMBLE
These general terms of sale (the “GTS”) apply to any reservation made by a Guest of La Suite Dior (The Dior Suite), located at 30 avenue Montaigne, 75008 Paris (“La Suite Dior”).
La Suite Dior is managed by the company Christian Dior Couture (the “CDC”) under the 30 Montaigne brand.
IT IS HEREBY AGREED AS FOLLOWS:
Article 1. DEFINITIONS
The terms used in these GTS, beginning with a capital letter shall be understood as follows.
Guest: refers to the adult individual, having full legal capacity to enter into commitments under the GTS, and acting for his/her own needs with the exception of any resale, distribution or intermediation activity for all or a part of the Hospitality Services provided by CDC.
Agreement: refers to the GTS and the Special Terms and Conditions.
Confidentiality Policy: refers to the personal data protection policy.
Special Terms and Conditions: refer to the special terms for reservation and cancellation relating to the Hospitality Service, which can vary seasonally, and which are indicated to the Guest at the time of reservation and are available on the Site and are also appended to the Reservation Confirmation.
Reservation Confirmation: refers to the confirmation email sent by CDC to the Guest containing a summary of the Agreement and mainly specifying the terms of the reservation (Hospitality Services booked, price and taxes, if any, dates and times of check-in and check-out from La Suite Dior, rules applicable to the stay at La Suite Dior, guarantee).
Hospitality Service: refers to the accommodation service at La Suite Dior, for the duration and on the dates selected by the Guest while making the reservation and under the conditions set forth in these GTS.
Article 2. PURPOSE
The Agreement governs the contractual relationship between the Guest and CDC, with whom the Guest makes a reservation.
The GTS prevail over any other document with respect to their subject matter, except for the Special Terms and Conditions that prevail over the GTS in case of conflict.
The Agreement expresses the entirety of the obligations of the parties. No general or specific condition communicated by the Guest can be incorporated into or added to the Agreement.
The GTS are provided to the Guest on the Site. The Guest can retain the GTS by using the standard features of his/her browser.
Article 3. DESCRIPTION OF HOSPITALITY SERVICES
The main features of the Hospitality Services are described in Appendix 2 of these General Terms of Sale, on the Site and in the Reservation Confirmation.

Article 4. RESERVATION
4.1. Reservation process
4.1.1. General provisions
Any reservation implies the consultation and the complete and unconditional acceptance of the GTS.
In the event of a reservation, the Guest is required to accept the GTS and the Special Terms and Conditions, which will be accessible via a hypertext link while making the reservation on the Site, by checking the corresponding box.
Requests can be communicated to La Suite Dior/CDC by telephone or email.
The Guest is solely responsible for his/her selection of the Hospitality Services and their suitability for his/her needs, such that the Company cannot be held liable in this regard.
Any reservation of a Service is nominative and can, under no circumstances, be transferred, neither free of charge nor against payment, in whole or in part, to a third-party. However, the name of a reservation can be changed at any time by contacting La Suite Dior by email or telephone.
4.1.2. Reservation process of a Hospitality Service
A Hospitality Service is reserved through a telephone call or by email:
- The Guest must indicate the desired date of check-in and check-out from La Suite Dior as well as the number of persons concerned by the reservation;
- The Guest must indicate his/her title, first name, last name and email address (and, if required, the title, last name and first name of the additional guest(s)), address, landline/mobile phone number, company name, if applicable;
- after a reservation is made by telephone, the Guest will receive an email requesting him/her to pay the cost of the reservation. The email shall contain a link to the payment site (the "Site") where the Guest will have to enter his/her banking information (card type, name of the card-holder, card number, expiry date, cryptogram) to make the payment;
- on the Site, the Guest is requested to accept the GTS and the Special Terms and Conditions, in order to be able to click on "Confirm the reservation and make payment".
A reservation can be made for the dates desired by the Guest only if La Suite Dior is available on those dates. The periods of availability of La Suite Dior will be communicated to the Guest when he/she makes the reservation.
4.2. Confirmation of the reservation
After the Guest has made a reservation for a Service in accordance with Article 4.1 above, he/she will receive a Reservation Confirmation at the email address that he/she provided over the telephone.
The reservation will be considered as final only after the Guest pays for the reservation in accordance with the conditions set out in article 6 of the GTS.
4.3. Right of withdrawal
Please note that, in accordance with Article L. 221-28, 12° of the French Consumer Code, the Guest does not have a right of withdrawal provided for in Article L. 221-18 of the French Consumer Code for Hospitality Services.
4.4. Cancellation or modification by the Guest
The reserved Hospitality Services are subject to the cancellation terms and conditions stated in these GTS and summarised in the Reservation Confirmation.
The Guest can only change the dates of the reservation for La Suite Dior with the express and written consent of CDC, which must be confirmed by email.
In case of cancellation or if the Guest does not show up on the first day of the reserved stay, CDC shall be entitled to charge a cancellation fee and, if required, charge the Guest the entire or a part of the price of the reserved Hospitality Services, which shall be deducted from the amount paid as advance payment and which, furthermore, shall be invoiced to the Guest. CDC is also entitled to resell the Service concerned.
It is recommended that the Guest obtain travel insurance that suits his/her needs.
4.5. Cancellation by the Company
If the Company refrains from executing the Agreement, please note that the Guest is entitled to receive compensation equal to the amount of the advance payment made by the Guest.
4.6. Interruption of the stay
Whatever the circumstances, in case of an interruption of the stay by the Guest, for any reason whatsoever, including behaviour that violates the rules of good conduct stated in article 5.5, CDC shall not be obliged to make any refund.
4.7. Irregularity in reservation
Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the Guest will result in the cancellation of the reservation of the Hospitality Services, without prejudice to any civil or criminal action against the Guest.
CDC shall be entitled to charge a cancellation fee in accordance with Article 4.4.
4.8. Complaint
Complaints relating to a purchase and/or the non-provision or improper provision of the Hospitality Services must, to facilitate their processing, be emailed to La Suite Dior and/or CDC at lasuitedior.reservation@christiandior.com.
Article 5. STAY AT THE SUITE
5.1. Imprint/Guarantee
La Suite Dior will request an imprint of the Guest's credit card upon arrival as a guarantee for the total amount of the Hospitality Services used during the stay and/or to cover any damage that may be caused by the Guest.
5.2. Registration card
Pursuant to Article R.611-42 of the French Code on the entry and stay of aliens, the Guest authorises La Suite Dior to pre-fill the individual police form known as the "registration card" with the information obtained at the time of reservation. The Guest will verify the accuracy of the pre-filled information and will sign the said form upon arrival.
5.3. Pets
Pets are welcome free of charge and dogs weighing up to 12 kg are allowed.
5.4. Children
Children must be supervised by their parents or a responsible adult.
5.5. No smoking
It is prohibited to smoke at La Suite Dior.
5.6. Internet and Wi-Fi
Guests can avail of free Wi-Fi.
Illegal downloading is strictly prohibited and falls under the responsibility of the Guest. The Guest is required to comply with La Suite Dior's security policy, including the rules for the use of the security measures implemented with the aim of preventing the illicit use of IT resources and refraining from any act that adversely affects the effectiveness of these measures.
The Guest undertakes to ensure that the IT resources provided to him/her by La Suite Dior shall, in no way, be used for the purposes of reproduction, representation, provision or communication, to the public, of the works or any objects protected by an intellectual property right or by a related right without the prior authorisation of the holders of the rights to any content protected under the provisions of the intellectual property code. The Guest shall indemnify CDC, at his/her own expense, against any action and/or claim initiated by a third-party alleging the violation of an intellectual property right, and shall bear all the associated costs and damages. In this respect, the Guest shall mainly compensate for all losses, damages or costs (including reasonable attorney's fees and expenses) incurred by the Company in connection with any such action, as well as for all the amounts of the settlements and/or damages that the Company may be ordered to pay.
5.7. Rules of good conduct
The Guest accepts and undertakes to use the room as a reasonable person and in compliance with the Code of Conduct of La Suite Dior. Hence, any behaviour that is contrary to good character, public order or the Code of Conduct can entitle CDC to ask the Guest to leave La Suite Dior, without any refund or compensation of any kind being granted to him/her in this regard.
5.8. Security
There are surveillance measures put in place at La Suite Dior. The reception and common areas of La Suite Dior are under video surveillance to ensure the safety of persons and property. Guests are provided with a safe at La Suite Dior.
However, Guests are advised to exercise caution, particularly as regards their valuable. Guests are particularly advised to not leave any valuables in plain sight (especially in the Suite or in the common areas).
5.9. Damage and loss
During the stay, the Guest is responsible for La Suite Dior provided to him/her and its furniture.
In general, the Guest is responsible for the consequences resulting from his/her negligence, faults, errors, and more generally for any damage, direct or indirect, tangible or intangible, caused to third-parties or to CDC, and whose occurrence is related to the Hospitality Services.
In case of damage or deterioration that is not declared prior to the Guest's departure from La Suite Dior, CDC reserves the right to deduct the amount necessary for the repair work as well as any related costs associated with La Suite Dior not being available during this period.
Article 6. FINANCIAL CONDITIONS
6.1. Price of the Hospitality Services
For the Hospitality Services, the price relating to the reservation includes for La Suite Dior, for the number of person(s), the dates and the Hospitality Services that may be selected by the Guest.
The price of the Hospitality Services is indicated by telephone while making the reservation, and on the Site, in the currency selected by the Guest, which may be different from the currency of La Suite Dior in which the payment will be made. Any costs for conversion to the currency of La Suite Dior that may be applied by the Guest's bank shall be borne by the Guest.
The price of the Hospitality Services is inclusive of all taxes, except for any taxes stated on the Site and mentioned in the Reservation Confirmation, which must be paid directly to La Suite Dior on its premises.
The price of the Hospitality Services only includes the services mentioned in the Reservation Confirmation. The services in addition to the Hospitality Services that may be provided by La Suite Dior during the Guest's stay will be added to the price mentioned in the Reservation Confirmation.
CDC can change the prices of the Hospitality Services at any time and without notice. However, the modified prices will only be applied to the reservations that are made after the new prices come into force.
6.2. Terms of payment
Reservations can only be paid for by card or bank transfer.
While paying for the reservation on the Site, the Guest shares his/her bank details to make the payment for the reserved Hospitality Services in accordance with the payment terms indicated on the Site. These terms are stated in the Reservation Confirmation.
The payment for the Hospitality Services is made in full, as an advance payment, while making the reservation on the Site.
Article 7. CANCELLATION POLICY
The Guest can cancel the reservation of the Hospitality Service that he/she has made under the following conditions. The conditions for cancellation differ depending on whether all or a part of the stay takes place during the Paris Fashion Week (an event organised by the Fédération de la Haute Couture et de la Mode. Its dates are available at https://fhcm.paris/fr/paris-fashion-week-fr/):
- During the Fashion Week:
- If the Guest cancels a Hospitality Service at least thirty (30) days prior to the check-in date indicated in the Reservation Confirmation, CDC will refund the entire advance payment;
- If the Guest cancels a Hospitality Service less than thirty (30) days prior to the check-in date indicated in the Reservation Confirmation, CDC will not refund the advance payment and this payment shall be forfeited;
- Outside of the period of the Fashion Week:
- If the Guest cancels a Hospitality Service at least fifteen (15) days prior to the check-in date indicated in the Reservation Confirmation, CDC will refund the entire advance payment;
- If the Guest cancels a Hospitality Service less than fifteen (15) days prior to the check-in date indicated in the Reservation Confirmation, CDC will not refund the advance payment and this payment shall be forfeited;
Article 8. PERSONAL DATA
In the context of providing the Hospitality Services or processing a reservation, CDC may be required to process personal data of the Guests, under the terms stated in the Confidentiality Policy available here.
Article 9. INTELLECTUAL PROPERTY
The "30 Montaigne" trademark, as well as all the figurative or non-figurative trademarks and, more generally, all the other trademarks, illustrations, images and/or logos of CDC displayed in the context of the Hospitality Services (the “Trademarks”) are and remain the exclusive property of CDC or are licensed to CDC.
The use of all or a part of the Trademarks, particularly by downloading, reproduction, transmission or representation for purposes other than those stated in these GTS is strictly prohibited.
Article 10. FORCE MAJEURE
The Parties agree to apply Article 1218 of the French Civil Code and the case-law of the French courts.
It is specified, for all practical purposes, that events resulting from personal reasons are not considered as force majeure events.
Article 11. CHANGES IN THE GENERAL TERMS OF SALE
CDC may update and modify these GTS. The conditions applicable to the sale of the Hospitality Services are those in force at the time of finalising the reservation, which are accepted by the Guest on the Site.
The Guest may store these GTS on a durable medium by taking a printout. The GTS as well as the Confidentiality Policy will be appended to the Reservation Confirmation sent to the Guest, allowing him/her to download and print them.
Article 12. GENERAL STIPULATIONS
If any of the stipulations of the Agreement should be declared invalid, inapplicable or unenforceable by any competent court, the other provisions shall remain valid, applicable and enforceable, unless otherwise provided by the said court.
The fact that one of the parties does not invoke a right or a breach by the other party shall not constitute a waiver to invoke the right or breach in question in the future. Any waiver shall only be enforceable if it has been expressed in writing by the party from whom it is issued to the other party.
For the purpose of convenience, the GTS have been translated into English. However, in the event of a dispute, the French text alone shall prevail.
Article 13. APPLICABLE LAW – DISPUTE
14.1 The Agreement is subject to French law. Except for imperative provisions to the contrary such as those resulting from the EC regulation no. 593/2008 of 17 June 2008 on the law applicable to contractual obligations (Rome I). This choice of law does not affect the Guest's right to benefit from the applicable consumer protection regulations in the Guest's country of residence.
In the event of a dispute relating to the Agreement and/or the Hospitality Services, the Guest undertakes to write to the La Suite Dior's Customer Department, on a priority basis, at lasuitedior.reservation@christiandior.com.
In case of any difficulty arising at the time of a reservation, the Guest can, before taking any legal action, seek to find an amicable solution with CDC and seek the intervention of the CMAP - Paris Mediation and Arbitration Centre, the consumer mediator under whose jurisdiction CDC falls. To submit a dispute to the mediator, the Guest can fill in the form on the CMAP website: www.cmap.fr, tab "you are: a consumer", send his/her request by simple or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or send an email to consommation@cmap.fr. Irrespective of the means used to refer the matter to CMAP, the Guest's request must contain the following elements for it to be quickly processed: his/her postal address, e-mail address and telephone number as well as the name and address of CDC, a brief statement of the facts, and proof of the steps taken by the Guest with respect to CDC prior to referring the matter to CMAP.
The Guest remains free to accept or refuse the option of mediation and, in case of opting for mediation, each party is free to accept or refuse the solution proposed by the mediator. In the absence of an amicable solution or opting for mediation, all disputes arising from the general terms of sale will be submitted to the competent court pursuant to the rules laid down by the Code of Civil Procedure and the Consumer Code. The Guest can initiate legal proceedings at the courts of (i) the place of domicile of CDC; or (ii) the place of domicile of the Guest; or (iii) the place where the Hospitality Services are delivered.

Appendix 1: Code of conduct
During their stay at La Suite Dior, guests are requested to:
- Respect the laws, cultural and religious practices and traditions of the country;
- Respect the contractual terms and the general terms of payment before, during and after the stay for all the products and services consumed and/or used;
- Respect the privacy, dignity, physical and moral integrity of all Christian Dior Couture employees;
- Use the facilities of La Suite Dior in an appropriate manner. Avoid any deliberate or accidental damage to them;
- More generally, avoid any immoral, illegal, indecent, inappropriate or unethical behaviour or behaviour that goes against public order and the local laws, including, but not limited to, verbal abuse, obscene or abusive gestures, physical violence, wrongdoing, drug abuse, alcohol abuse or any other behaviour that may be a source of nuisance to the staff of La Suite Dior.
Any violation of the above principles may lead to corrective or preventive actions depending on the nature of the violation, mainly restricted access to La Suite Dior or the implementation of special terms and conditions for future reservations.
